Section 1: Acceptance of Terms

1.1 Agreement to Terms

(a) We are Kevin Olding, trading as Mathsaurus. You can contact us by emailing us at [email protected] or using the support facility at Support – Mathsaurus.

(b) You are the person accessing our services and, where applicable, registering for an account, either for yourself or on behalf of a student aged under 18. You provide your personal details when you register with us.

(c) These Terms cover everything we offer through our website at www.mathsaurus.com and any subdomain of it (our Website), including our courses on courses.mathsaurus.com (our Learning Platform). They also cover our Products, whether physical or digital, and our Services, including live 1 to 1 and group tuition sessions, however these are delivered. By accessing, purchasing or using any of them, whether as a guest or a registered user, you agree to be bound by these Terms of Service (‘Terms’ or ‘Terms of Service’). If you do not agree to these Terms, you must stop using or accessing our services and the Learning Platform.

1.2 Changes to Terms

(a) We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms at any time. Please check these Terms periodically for changes. Your continued use of any, all or part of our Products and/or Services and/or Learning Platform after the posting of changes constitutes your binding acceptance of such changes. We will make reasonable efforts to notify users of any significant changes to these Terms, but it is your responsibility to check and to review the Terms periodically.

(b) Acceptance of Changes - Your continued use of our Products and/or our Services and/or our Learning Platform following the posting of changes to these Terms will mean you accept those changes. If you do not agree to the new terms, please stop using the Mathsaurus website and services.

1.3 Eligibility

(a) You affirm that you are more than 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.

(b) If you are under 18, you may only use our Products and/or our Services and/or our Learning Platform with the permission of a parent or legal guardian. That parent or guardian accepts full responsibility for your use of the site and its content.

(c) Children under 13 years of age must only use our Products and/or our Services and/or our Learning Platform under the direct supervision of an adult.

(d) School access to free courses – (i) We are happy for teachers to use our free courses with their classes. A teacher may create an account on the Learning Platform and give their students access to any course where no fee is payable.

(ii) Teachers and their schools are responsible for making sure any permissions they need are in place.

1.4 Electronic Communications

(a) By purchasing, registering for, or using our Products, Services, or Learning Platform, you consent to receive electronic communications from us. These may include important notices about fees, charges, account activity, service updates, and other information related to your use of our Products, Services, or Learning Platform. You agree that such communications satisfy any legal requirement that communications be in writing.

(b) (i) You may choose to receive promotional emails from us, such as updates about new courses, special offers, and educational resources. We will only send these if you have actively opted in. If you did not opt in during registration, you may do so at any time by updating your preferences or selecting the relevant option by emailing us at [email protected] or using the support facility at Support – Mathsaurus.

(ii) You can also withdraw your consent and unsubscribe from promotional emails at any time by using the link provided in each message.

(c) Please note that even if you unsubscribe from promotional communications, we may still send you essential service-related emails. These include transactional messages necessary to manage your account, deliver services, or comply with legal obligations.

2.1 Products and Services Offered

(a) Our Products and/or our Services and/or our Learning Platform provide a range of products, online mathematics courses, 1-1 tuition, and group tuition services. These are designed to offer educational content and resources primarily in the field of mathematics.

(b) Details of the Products and Services which you will receive are shown on the relevant sales page, in your order confirmation or in your Welcome Email (the first email which we send to you after you sign up for free content or purchase Products and/or our Services and/or access to content on our Learning Platform).

2.2 Course Access and Delivery (Pre-recorded Courses)

Our pre-recorded courses are delivered online through the Learning Platform. Upon registration and payment (if applicable), users are granted access to the course materials, which may include video lessons, exercises, quizzes, and other educational resources. These courses are designed for self-paced learning and can be accessed at any time they are available on the Learning Platform by registered users.

2.3 Live Tuition (1-1 and Group Sessions)

In addition to pre-recorded courses, Mathsaurus may offer live 1-1 and group tuition sessions conducted via Zoom, subject to availability. These sessions are subject to separate booking and scheduling arrangements. These live sessions provide personalised instruction and interaction, complementing our range of pre-recorded courses.

2.4 Course Content

The content provided in our courses, both pre-recorded and live, is developed with care and updated from time to time. While we strive to provide high-quality educational material, we do not guarantee that the content is accurate, up to date or will meet every user’s needs or expectations.

2.5 Additional Features

Mathsaurus may also offer various tools, forums, and support services to enhance the learning experience for both our pre-recorded and live tuition services. These features are subject to change, improvement, or discontinuation at any time without prior notice.

2.6 Changes to the Service

Mathsaurus reserves the right to modify, suspend, or discontinue any aspect of the service at any time, including the availability of any website feature, database, or content. We may also impose limits on certain features and services or restrict access to parts or all of the services without notice or liability.

Section 3: User Registration and Accounts

3.1 Account Creation

To access certain features of our Products and/or our Services and/or our Learning Platform, including enrolling in courses or participating in live tuition sessions, users must create an account. When creating an account, you must provide accurate and complete information. Each user is responsible for their account information and should update it as necessary to keep it current.

3.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your account username and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account or password. If you believe your account has been unlawfully accessed, you should immediately inform us by emailing us at [email protected].

3.3 Account Security

We take reasonable steps to protect the security of your account information but cannot guarantee absolute security. You play a crucial role in keeping your account secure. Mathsaurus is not liable for any loss or damage arising from your failure to comply with this security obligation.

3.4 Account Usage

(a) Your account is for your personal, non-commercial use only. You may not use your Mathsaurus account for any unauthorised or illegal purpose. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at Mathsaurus’s discretion.

(b) Unless you have our specific written permission you may not share your account or any content on the Learning Platform with any other person or organisation, or allow them to access or use all or any part of it, including for any commercial or non-commercial purposes, nor can you copy, modify or publish (such as on social media) in any way. Please also refer to section 4 which explains user responsibilities and section 6 which explains our Intellectual Property Rights.

3.5 Account Termination

Mathsaurus reserves the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete. You may also terminate your account at any time by emailing us at [email protected] or using the support facility at Support – Mathsaurus. Please also see clause 10 following.

Section 4: User Responsibilities

4.1 Lawful Use

You agree to use Mathsaurus and its Products and/or our Services and/or our Learning Platform only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s rights nor use and enjoyment of Mathsaurus. Prohibited behaviour includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within Mathsaurus.

4.2 Upload, content and Interaction

(a) You are responsible for your interactions with other users and for the content you upload, post, or otherwise transmit through Mathsaurus. We do not monitor or control interactions nor the content posted by users and do not take responsibility for such content. However, we reserve the right to remove any content that we believe violates these Terms of Service or is deemed harmful, offensive, or inappropriate or may breach anyone’s rights or be contrary to any relevant law.

(b) You therefore specifically agree that we have no liability and that you will indemnify us for any loss relating to any actual or alleged breach of this clause.

4.3 Compliance with Policies

(a) Mathsaurus operates according to certain policies and guidelines, including, but not limited to, our mission and values which you can read here and our Privacy Policy which you can read here.

(b) By using Mathsaurus, you agree to comply with all policies and guidelines provided, including any course-specific rules or instructions. Failure to comply with these policies may result in suspension or termination of your access to the services. For the avoidance of any doubt, these policies are available on our Website and Learning Platform.

4.4 Accuracy of Information

You agree to provide true, accurate, current, and complete information about yourself as prompted by the service’s registration form and maintain and promptly update your registration data to keep it true, accurate, current, and complete.

4.5 Security Breaches

If you become aware of any unauthorised use of your account or any other breach of security, you must notify Mathsaurus immediately by emailing us at [email protected] or using the support facility at Support – Mathsaurus. Mathsaurus will not be liable for any loss or damage arising from your failure to comply with this section.

4.6 Licence:

(a) Subject to Third Party rights, we own the Products, Services, Learning Platform, logo, techniques, information, documents, training and all materials and content, including Digital Content, and any rights (such as copyright and other intellectual property rights in the fullest sense).

(b) Provided always that you’ve paid any agreed payment to us and do not breach our Terms, any of our rights or those of any Third Party you have a non-exclusive right (licence) to use it for yourself, for as long as

(i) we are providing you with our Services or have otherwise agreed in writing OR

(ii) as detailed on the Website or Learning Platform. If we haven’t included this on the Website or Learning Platform, then it’s for as long as the Products and content are available.

4.7 No Resale of Service

You agree not to share, reproduce, duplicate, copy, sell, trade, resell, or exploit for any commercial purposes, any portion of the service (including your Mathsaurus account), use of the service, or access to the service.

Section 5: Course Fees and Payment Terms

5.1 Course Fees

(a) The fees for our Products, Services, and access to content on the Learning Platform are as listed on our Website and/or the Learning Platform or emailed to you before you purchase and confirmed to you in the relevant Welcome Email. We reserve the right to change these fees from time to time. All fees are due at the time of registration or enrolment, unless otherwise specified.

(b) Extras: Anything not included in what we agreed to provide when you purchased is an Additional Service. We are under no obligation to provide Additional Services. If we do agree to, we will agree a price and payment terms with you before we start.

5.2 Payment Methods

Payment Products, Services, and access to content on the Learning Platform can be made via the payment methods accepted on our Website and/or the Learning Platform, which may include credit card, debit card, and other electronic payment methods. By submitting your payment information, you authorise us to process and complete the transactions.

5.3 Consumer Rights and Cancellations: Consumers (as defined in s2(3) of the Consumer Rights Act 2015 as individuals acting for purposes that are wholly or mainly outside that individual’s trade, business, craft or profession) who buy at a distance (such as by email or phone or from a website or Learning Platform), may have a legal right to change their mind and cancel some orders, including some Digital Content (our pre-recorded courses and other material you stream or download). If this right applies, then you usually have 14 days from the date after you place your order to cancel the order. However,

(a) If you choose to access Digital Content immediately, you waive your right to cancel, and no refund will be available once access begins

(b) If you cancel after we have already started providing other Services at your request, you must pay for the Services you have received up to that point.

5.4 Refund Policy

Subject to Consumer Cancellation Rights

(a) Refunds for pre-recorded online courses (including those where Consumers have given their express consent to waive rights) are not available due to immediate access to the course content upon purchase.

(b) For live 1-1 and group tuition, classes are not refundable after purchase. If we cancel a live class, you can choose either a refund or a transfer to another class. Where we state specific refund details on the sales page for an individual class, those details apply.

5.5 Offers: Any offers which we may make available (such as Early bird, coupon codes, exclusive discounts, promotions or free to access resources) are not retrospective, not transferable, can’t be exchanged for cash and are subject to availability and the terms and conditions of that offer. You can only use one offer per order.

5.6 Subscriptions: Subject to any contrary provision by law, if you purchase a subscription then it will automatically renew once your current subscription expires. We send timely reminders prior to the renewal and if you want to cancel a subscription renewal please do so by emailing us at [email protected] or using the support facility at Support – Mathsaurus.

5.7 Late Payments

In cases where payment is due but not received by us, access to the course or service may be suspended, without liability, until full payment is made.

5.8 Currency

All transactions are processed in the currency stated on our website and/or Learning Platform. Users are responsible for any currency conversion fees or related charges incurred by their bank or credit card issuer.

5.9 Changes to Fees and Payment Terms

Mathsaurus reserves the right to change its fees and payment terms at any time. Any such changes will be communicated through the website and will apply to any enrolments or registrations made after the changes are posted.

Section 6: Intellectual Property Rights

6.1 Ownership of Content

Subject to the rights of any third party, all content provided by and on Mathsaurus and the Learning Platform, including but not limited to all content, text, graphics, images, video, information, logos, button icons, software, audio files, and computer code, is the exclusive property of Mathsaurus or its content suppliers and is protected by international copyright and intellectual property laws. All rights not expressly granted are reserved.

6.2 Use of Content

The content on Mathsaurus is provided for your information and personal, non-commercial use only. You may not use, copy, modify, reproduce, distribute, transmit, broadcast, display, sell, license, disable, interfere or tamper with, create a derivative work of, reverse engineer, reverse assemble or otherwise use or exploit any content for any other purposes without prior written consent of Mathsaurus or the respective licensors of the content.

6.3 User-Generated Content

Users may be able to submit content, such as comments, exercises, or reviews. You retain all rights in, and are solely responsible for, the user-generated content you post to Mathsaurus. However, by submitting content, especially reviews, you grant Mathsaurus a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform such content in connection with the service provided by Mathsaurus, and for promotional purposes, including but not limited to use on social media platforms. This Licence will be terminated when such content is entirely deleted from the Website and/or Learning Platform.

6.4 Third-Party Intellectual Property

Some content on Mathsaurus may be owned by third parties, such as educational bodies or collaborators. This content is subject to intellectual property rights held by those parties and may only be used in accordance with their specific terms and conditions. 8.3 User Responsibility

Any material used, downloaded or otherwise obtained through the use of the Mathsaurus service is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

8.4 Variation

We reserve the right to vary or withdraw products or services for sale or make changes to their price without any notice.

Mathsaurus reserves the right to terminate or suspend your access to all or part of the Mathsaurus website and its services, with or without notice, for any reason, including, without limitation, breach of these Terms of Service. Upon termination, your right to use the Mathsaurus services will immediately cease.

10.2 User Initiated Termination

As a user, you may terminate your account and discontinue your use of Mathsaurus services at any time. Please be aware that terminating your account may result in the deletion of all content associated with your account.

10.3 Effect of Termination

Upon termination or suspension, regardless of the reasons therefore, your right to access the services available on Mathsaurus immediately ceases, and you acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Mathsaurus service.

10.4 Survival of Terms

Termination of your access to and use of the Mathsaurus services shall not relieve you of any obligations arising or accruing prior to such termination or limit any liability that you otherwise may have to Mathsaurus or any third party.
